Chef W. is a specialist in Huaiyang cuisine. His evidence included winning gold medals in international cooking competitions in Singapore and serving as a judge for a national contest in China.
The RFE Challenge
USCIS issued an RFE questioning his "Commercial Success," stating his salary, while high, wasn't "significantly" higher than top US chefs in major cities. They compared him to celebrity chefs.
The Winning Response
We pivoted away from "Commercial Success". instead, we bolstered the "Leading Role" argument. We provided organizational charts and letters showing he was the Head Chef of a 5-star hotel's flagship restaurant, directing a team of 40. We also provided more evidence of his "Display of Work" at artistic exhibitions (food expos). The officer accepted the "Leading Role" + "Awards" + "Judging" + "Exhibitions" combination.
