The "6-Month Rule" Myth

Many think coming back to the US once every 6 months ("Touching Base") is enough. It is not. CBP officers look at intent. If you live abroad, you are abandoning residence.

The Solution: I-131 Re-entry Permit

If you need to leave for > 1 year (e.g., caring for parents, external job rotation), you MUST file for a Re-entry Permit.

  • Validity: Allows you to stay away for up to 2 years without abandoning status.
  • Critical Rule: You must be physically present in the US when you file and when you do biometrics. Do not mail it and leave the next day.
  • Recurring Use: You can apply for a second one. We have clients who have worked in China for 5-6 years while keeping their Green Card valid using this method.
